US LLC for Moroccan residents

The US side is the same as for any non-resident. The Moroccan side — exchange control and taxes — is where most founders need advice before they start.

Settle the Moroccan side firstMoroccan residents are subject to exchange-control rules (Office des Changes, IGOC 2026) on investments abroad and on foreign-currency income, and to Moroccan tax on their worldwide income. Get written advice from a Moroccan accountant or adviser on your exact situation before funding or using a foreign company.

The US steps

Forming the LLC, getting the EIN and filing Form 5472 work exactly as described in our step-by-step guide. Moroccan passport holders can obtain an EIN without an SSN through Form SS-4.

Questions to answer on the Moroccan side

  1. Funding the LLC. Transferring capital abroad as a resident is regulated. Check which route applies to you under the IGOC 2026 and whether prior authorisation or declaration is needed.
  2. Receiving income. Foreign-currency income must be handled under Office des Changes rules. Residents with foreign-source income may hold part of it in a foreign-currency or convertible-dirham account (Circular 3/2020 allows up to 70%).
  3. Taxation of the profits. A US single-member LLC is usually transparent for US tax, so the profits are generally taxable in Morocco. Check how your situation is treated under Moroccan tax law and the Morocco–United States tax treaty.
  4. Your status in Morocco. Self-employed (auto-entrepreneur), company or individual: each changes how income is declared.

Banking from Morocco

Fintech providers accept many non-resident founders, but acceptance depends on country of residence and changes over time — check each provider's eligibility list for Morocco before forming. Payoneer is widely used in Morocco to receive payments from US platforms.
